Terms of Sale

These terms cover what happens when you order from us: how an order is confirmed, how you pay, what you can expect from us and what we expect from you. They apply together with our Delivery Policy, Refund and Returns Policy and Privacy Policy.
About these terms
These terms apply to every order you place with Jowam Coffee Roasters ("Jowam", "we", "us") through https://jowamroasters.com, and to orders placed by WhatsApp, email or phone. They also cover your use of the website.
When you tick the box on the order form, you confirm that you have read and accept these terms, the Delivery Policy and the Refund and Returns Policy, and that you have read the Privacy Policy. The version in force on the day you place your order is the one that applies to it.
Wholesale accounts and bookings for cupping, barista training or private events have their own terms, which apply on top of these.

Who can order
You must be 18 or older to place an order, or have a parent or guardian place it for you. The name, phone number, email and address you give us must be your own or ones you are allowed to use, and they must be accurate. We rely on them to confirm, deliver and support your order.
How your order becomes a contract
Placing an order on the website is an offer to buy. The order reference and confirmation email you receive tell you we have your order. They do not yet mean we have accepted it.
We accept your order when we contact you by WhatsApp or email to confirm the items, the delivery fee and the total, and you pay. At that point a binding contract exists between us.
We may decline an order, for example when an item is out of stock, a price was shown in error, we cannot deliver to your area, or we have reason to believe the order is not genuine. If you have already paid for an order we decline, we refund you in full.
Prices and payment
All prices are in Kenya shillings and include any VAT that applies. Delivery is charged separately. We tell you the delivery fee before you pay, and you never pay more than the total we confirm with you.
If a price on the website is wrong, we will tell you the correct price before you pay. You can then go ahead at the correct price or cancel at no cost.
We take payment by M-Pesa to the Paybill or Till number we give you when we confirm your order. Please keep these points in mind:
- Only pay to a number we send you from our official WhatsApp or email.
- Check that the M-Pesa confirmation shows Jowam as the recipient before you enter your PIN.
- We will never ask for your M-Pesa PIN, a reversal, or payment to a personal number.
If an order is not paid within 48 hours of our confirmation, we may cancel it. We give you a receipt for every paid order, and a tax invoice on request.
Our products
Coffee is a natural product. Taste, colour and roast can vary a little between harvests and batches, and the tasting notes we give are a guide rather than a promise. Photos show what the product usually looks like, and packaging can change.
Bag weights are measured at packing. Coffee tastes best within a few weeks of roasting, so store it sealed, away from heat, light and moisture.
Products are available while stock lasts. If something you ordered runs out before we confirm, we will offer you an alternative or remove it from the order.
Cancelling an order
You can cancel at no cost at any time before we dispatch your order or hand it over for pickup. If you have paid, we refund you in full.
Once we have ground coffee to your instructions, that coffee cannot be cancelled unless it is faulty, because we cannot sell it to anyone else. After dispatch, our Refund and Returns Policy applies.
If we did not give you the information the Consumer Protection Act, 2012 requires for a remote sale, you may cancel within the time that Act allows.
Your legal rights
Under the Sale of Goods Act and the Consumer Protection Act, 2012, the goods we sell you must match their description, be of good quality and be fit for their purpose. Nothing in these terms takes away or limits those rights.
Our responsibility to you
If we break these terms or act negligently, we are responsible for loss you suffer that was a foreseeable result. We are not responsible for loss that was not foreseeable, or for loss of profit or business opportunity, because our retail products are sold for personal use.
Apart from that, our total responsibility for any order is limited to the amount you paid for it, including delivery. This limit does not apply to death or personal injury caused by our negligence, to fraud, or to anything else the law does not allow us to limit.
Events outside our control
We are not responsible for delays or failures caused by events we cannot reasonably control, such as power or network outages, M-Pesa downtime, fuel shortages, floods, road closures, strikes or public unrest. We will tell you as soon as we can and agree a new time with you, or refund you for anything we cannot supply.
Using our website
The text, photos, logos and design on this website belong to Jowam or are used with permission. You may view and share them for personal, non-commercial use. Please do not copy them for commercial use without asking us first.
You must not use the website to place false orders, send spam, collect other people's data, or interfere with how the site works. We may block access or cancel orders where we see this.
We work to keep the website available and accurate, but we cannot promise it will always be free of errors or interruptions. Links to other websites, such as Google Maps, Instagram or TikTok, are there for convenience, and those sites have their own terms.
Messages and records
You agree that order confirmations, receipts and other notices may be sent to you by WhatsApp or email, and that they count as written notice. Electronic records are recognised under the Kenya Information and Communications Act.
Complaints
If something goes wrong, tell us first. Email hello@jowamroasters.com, call or WhatsApp +254 115 527 473, or visit us at Lavington Mall, James Gichuru Road, Nairobi, Kenya. Please include your order reference. We acknowledge complaints within 2 working days and aim to resolve them within 14 days.
If we cannot resolve a complaint between us, you can contact the Competition Authority of Kenya, which handles consumer complaints, or take the matter to the Small Claims Court.
Changes to these terms
We may update these terms from time to time, for example when the law or our service changes. The date at the top of this page shows the latest version. Changes do not affect orders already placed.
Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute about them. If you are a consumer, nothing here stops you from using the Small Claims Court or any other forum the law gives you.
General
If a court finds any part of these terms invalid, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. These terms, together with the policies they refer to, are the whole agreement between us about your order.
